GENERAL INFORMATION

These general contract conditions govern the relationship between the customer and Rosamunda – Acciugha S.r.l. Unipersonale for the purchase of products made available on the site.

These general conditions (the “General Conditions”) are governed by Legislative Decree 6 September 2005 n. 206 (“Consumer Code”) containing the provisions for the protection of consumers and in particular articles 50 to 68 relating to distance selling.
By ticking the “I accept the Terms and Conditions” box that you compare during the online purchase procedure, the buyer accepts all the contractual conditions set out below. In the absence of express acceptance of the General Conditions, it will not be possible to complete the online purchase procedure.

PRODUCT AVAILABILITY

All products are subject to current availability. Rosamunda – Acciugha S.r.l. Unipersonale reserves the right at any time to vary the limits on the quantities and/or types of goods that can be purchased online on the site. The Customer will be informed if his order is unexecutable due to the unavailability of the ordered product.

PRICE

Product prices are expressed on the site in € (Euros) and include all applicable taxes or duties. Delivery costs and costs applicable to different types of payment are excluded, unless otherwise expressly indicated. Rosamunda – Acciugha S.r.l. Unipersonale constantly checks that all prices indicated on the site are correct, without however guaranteeing the absence of errors. In the event that an error is found in the product price, Rosamunda – Acciugha S.r.l. Unipersonale will give the Customer the opportunity to reconfirm the purchase of the products at the correct price or to cancel it.

PURCHASE METHODS

The essential characteristics and prices of the products are shown in the offer relating to each individual item on the site. To purchase the products the Customer must complete and send to Rosamunda – Acciugha S.r.l. Unipersonale the purchase order form in electronic format, following the instructions contained on the site.

CONCLUSION OF THE CONTRACT

The Contract stipulated between Rosamunda – Acciugha S.r.l. Unipersonale and the Customer must be considered concluded when the order and the related payment are received by Rosamunda – Acciugha S.r.l. Unipersonale. The order sent by the Customer will be binding for Rosamunda – Acciugha S.r.l. Unipersonale only if the entire purchase procedure has been completed regularly. Rosamunda – Acciugha S.r.l. Unipersonale is not responsible for malfunctions caused by the data transmission network operator. By sending the order to Rosamunda – Acciugha S.r.l. Unipersonale the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept the General Conditions. The purchase order form will be archived on the Paypal platform in compliance with current privacy regulations. Rosamunda – Acciugha S.r.l. Unipersonale will send to the Customer, via e-mail, a confirmation of receipt of the purchase order sent by the Customer, containing the information relating to Rosamunda – Acciugha S.r.l. Unipersonale, the essential characteristics of the products purchased, the order placement data, the address of Rosamunda – Acciugha S.r.l. Unipersonale to which complaints can be submitted, detailed indication of the price, the payment method chosen by the Customer and the delivery costs. The Customer must verify the content of the communication and report to Rosamunda – Acciugha S.r.l. Unipersonale of any errors or omissions.

TERMS OF PAYMENT

The Customer will be able to pay the price of the products and the related delivery costs by paying by credit card, bank transfer and PayPal. Rosamunda – Acciugha S.r.l. Since the debit timing may vary based on the banking circuits used, it follows that the delivery days are considered starting from that date.

USE OF THE SITE

The essential characteristics of the products are presented on the site within each product sheet. The images and colors of the products offered for sale on the site may not correspond perfectly to the real ones due to the Internet browser and monitor used when connecting to the site.

TRANSPORT AND DELIVERY

For security reasons, the products purchased on the site will be sent to the address resulting from the registration and the signature of an adult over 18 will be required at the time of delivery.
No deliveries will be made to post office boxes. Delivery costs are borne by the Customer and are clearly highlighted in the order form. They may vary depending on the quantity of products shipped and the place of destination of the products.
Delivery costs may undergo variations: however, these modifications will not have value for purchase orders issued before the publication of the modifications on the Site.
Orders will be processed and shipped from Monday to Friday, excluding holidays and national holidays.
Rosamunda – Acciugha S.r.l. Unipersonale is not responsible for non-compliance or unforeseeable delays in the execution of the order in the event that such non-compliance or delays are caused by impediments such as work interruptions, trade union unrest, suspension of transport and any other cause that may constitute a due impediment due to force majeure or unforeseeable circumstances, it being understood that, except in cases of force majeure, the products will be sent within a maximum period of 30 (thirty) days starting from the day following the day on which the Customer sent the order in Rosamunda – Acciugha S.r.l. Unipersonale. For the delivery of the goods, the presence of the Customer or his representative at the recipient’s address indicated in the order is required. Upon delivery of the goods by the Courier, the Customer is required to check that the packaging is intact, not damaged, wet or otherwise altered, including the closing materials. Any damage to the packaging and/or the product must be immediately reported, placing a written control reservation on the courier’s proof of delivery. Once the Courier’s document has been signed, the Customer will not be able to make any objections regarding the external characteristics of what was delivered. If it is unable to deliver the goods ordered following the unavailability, even temporary, of the products, Rosamunda – Acciugha S.r.l. Unipersonale will promptly notify the Customer, and in any case no later than 30 (thirty) days, via email. The amount already paid by the Customer will be refunded no later than 30 (thirty) days from notification of the impossibility.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the contract concluded with Rosamunda – Acciugha S.r.l. Unipersonale, without any penalty and without specifying the reason, within 14 (days) starting from the day of receipt, of the products purchased on the site.
In case of exercise of the right of withdrawal, even partial, the return of the products must be made in a single solution. If the Customer intends to exercise the right of withdrawal referred to in this article, he/she must: send a notification email to info@rosamunda.it, attaching the Shipping Confirmation sent by Rosamunda – Acciugha S.r.l. Unipersonale specifying in the text of the email the numerical code of the item or items to be returned (hereinafter “Returned Products”) and the reason for the return “for free withdrawal”; contact a courier of your choice and send the products to be returned within the next 5 (five) days from the notification via e-mail of the withdrawal. In this case the Customer assumes all responsibility in the event of loss or damage to the products themselves during transport up to the time of delivery. Rosamunda – Acciugha S.r.l. Unipersonale, in the event of the Customer exercising the right of withdrawal, will not accept the return of returned products that are altered or damaged. If the right of withdrawal is exercised following the methods and terms described in this article, Rosamunda – Acciugha S.r.l. Unipersonale will send the Customer, via email, as soon as possible the relevant confirmation of acceptance of the returned products and the due refund. Delivery costs for returning the products are borne by the Customer; any cost incurred by the Customer for redelivery will not be refundable. In any case, the cash on delivery method of return is prohibited.

Returns for defects or non-conformities of the products

In the case of products that are defective or different from those ordered (hereinafter “Defective Products”), the Customer, without any exception, must send a reporting email to Rosamunda – Acciugha S.r.l. Unipersonale, at info@rosamunda.it, attaching the shipping confirmation sent by Rosamunda – Acciugha S.r.l. Unipersonale and specifying in the text of the email the name of the item or items to be returned and the reason for the return due to “product defects”. Rosamunda – Acciugha S.r.l. Unipersonale will contact the shipping company to book the collection within 14 (fourteen) days from the communication, via e-mail, of the withdrawal to Rosamunda – Acciugha S.r.l. Unipersonale; communicate to the Customer via e-mail the date set for collection. From the moment of delivery of the defective products to the designated shipping company, Rosamunda – Acciugha S.r.l. Unipersonale exempts the Customer from any liability in the event of loss or damage to the products themselves during transport.

PRODUCT REPLACEMENT

To obtain the replacement of a product purchased on the site, you must contact Rosamunda – Acciugha S.r.l. Unipersonale by indicating the code of the product received and clearly indicating the name of the new product you wish to receive. We would like to point out that the product to be replaced must be sent to Rosamunda – Acciugha S.r.l. Unipersonale in the original state of dispatch and that the fulfillment of the new order is subject to the current availability of the products by Rosamunda – Acciugha S.r.l. Unipersonale. Shipping costs for returning the product are borne by the Customer. The replacement product will be sent to the Customer by courier.

DISPUTES

For any dispute relating to the General Conditions, the Court of Rimini will have exclusive jurisdiction.
